Please read these Terms of Use carefully before accessing or using any part of the Exviona platform available at wigomia.pro. By accessing or using the platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the platform.
1. Definitions
Throughout these Terms, the following definitions apply:
- Platform refers to the Exviona website, applications, and all associated services operated under wigomia.pro.
- User refers to any individual who accesses, browses, registers on, or otherwise interacts with the Platform.
- Account refers to the registered profile created by a User to access restricted features of the Platform.
- Content refers to all text, video, audio, images, materials, and other information made available through the Platform.
- We, Us, Our refers to Exviona and its authorized representatives.
2. Eligibility
You must be at least 18 years of age to use the Platform. By agreeing to these Terms, you represent and warrant that you meet this age requirement. If you are accessing the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Account Registration
3.1 Creating an Account
Certain features of the Platform require you to register for an Account. You agree to provide accurate, current, and complete information during registration and to keep that information updated at all times.
3.2 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You must notify us immediately at [email protected] if you suspect any unauthorized access to your Account. We are not liable for any loss resulting from unauthorized use of your Account.
3.3 Account Termination by User
You may close your Account at any time by contacting us. Upon closure, your access to paid Content or enrolled courses may be terminated in accordance with the applicable refund policy.
4. Permitted Use
You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms. You are permitted to:
- Access and view Content for personal, non-commercial educational purposes.
- Download materials explicitly made available for offline use.
- Participate in discussions, exercises, and interactive features offered within the Platform.
5. Prohibited Conduct
You must not engage in any of the following activities:
- Reproduce, distribute, publicly display, or create derivative works from any Platform Content without prior written permission.
- Share, sell, sublicense, or transfer your Account or access credentials to any third party.
- Use automated tools, bots, scrapers, or crawlers to extract data from the Platform.
- Attempt to gain unauthorized access to any part of the Platform, its servers, or related systems.
- Upload or transmit viruses, malware, or any other harmful code.
- Engage in conduct that harasses, threatens, or harms other Users or Platform staff.
- Use the Platform to promote or distribute unsolicited commercial communications.
- Misrepresent your identity or affiliation with any person or organization.
- Circumvent any technological measures designed to protect Content or Platform functionality.
6. Intellectual Property
6.1 Ownership
All Content, trademarks, logos, and materials on the Platform are the property of Exviona or its content licensors and are protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you.
6.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and its Content strictly for personal educational purposes as permitted under these Terms.
6.3 User Submissions
If you submit any feedback, comments, or other materials to the Platform, you grant Exviona a worldwide, royalty-free, perpetual license to use, reproduce, and adapt such submissions for Platform improvement and promotional purposes, without any obligation to compensate you.
7. Payments and Subscriptions
7.1 Pricing
Certain services and courses on the Platform are offered for a fee. All applicable prices are displayed at the point of purchase. Prices may be subject to applicable taxes depending on your location.
7.2 Billing
By completing a purchase, you authorize Exviona to charge your chosen payment method for the stated amount. For subscription-based services, billing occurs on a recurring basis until you cancel.
7.3 Refunds
Refund eligibility is governed by our separate Refund Policy. We encourage you to review it before making any purchase. We reserve the right to deny refund requests that do not meet the stated criteria.
7.4 Price Changes
We reserve the right to modify pricing at any time. Changes to subscription pricing will be communicated in advance and will take effect at the start of the next billing cycle.
8. Third-Party Services and Links
The Platform may contain links to third-party websites or integrate third-party tools and services. These are provided for convenience only. We do not endorse, control, or assume responsibility for any third-party content, privacy practices, or services. Your interactions with third-party services are governed solely by their respective terms and policies.
9. Disclaimer of Warranties
The Platform and all Content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We make no guarantees regarding the accuracy, completeness, or suitability of any Content for your specific purposes.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Exviona and its officers, employees, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to loss of data, loss of profits, or business interruption, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total amount paid by you to Exviona in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Exviona and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with your use of the Platform, your violation of these Terms, or your infringement of any rights of a third party.
12. Modifications to the Platform
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
14. Termination
We reserve the right to suspend or terminate your access to the Platform at our sole discretion, without prior notice, if we believe you have violated these Terms or engaged in conduct harmful to other Users or to Exviona. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.
15. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.
16. Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Exviona with respect to your use of the Platform and supersede all prior agreements, understandings, and representations.
